Prior to filing a trademark application we encourage a trademark search to be conducted. These searches help identify any possible issues that may arise during government examination of your application and allow you to make the most informed decision moving forwards. All searches come with a report and opinion, however there are different types available depending on your budget.

There are several 'systems' used in Australia for filing of trademark applications, depending on how you wish to describe your goods/services, and how many 'classes' these goods and services fall into.

After the government department has examined your application, assuming they find no reason to object to its registration they will issue an acceptance letter. The acceptance of your trademark will be advertised in the Australian Official Journal of Trademarks for the purpose of allowing third parties an opportunity to file opposition to your mark becoming registered. They will have three months from the advertisement date to do this (or request an extension of time). Assuming there are no oppositions filed, your mark may then register once final fees are paid.
